IND Readiness and the FDA Marketing Application Filing Checklist: Managing Regulatory Risk to Prevent RTFs

Getting a drug program into and through FDA review depends heavily on preparation. Two points in the development lifecycle carry particularly high risk: the Investigational New Drug (IND) application that allows clinical studies to begin and the marketing application (NDA or BLA) that seeks approval. At both stages, an incomplete or poorly organized submission can create delays. In the case of a marketing application, those gaps may lead to a Refuse to File (RTF) decision that sends a sponsor back to address deficiencies before review can even begin. Increasingly, organizations are treating readiness not as an administrative exercise, but as a critical component of regulatory risk management.

Under 21 CFR 314.101, FDA conducts an initial filing review within 60 days of receiving an application. During that process, the agency determines whether the submission is sufficiently complete to proceed into formal review. Applications that are incomplete or improperly organized may receive a Refuse to File decision.

For that reason, many organizations rely on structured filing checklists before submission. These reviews help confirm that:

  • Required components are present for the application type and indication.
  • Information is organized in the expected format.
  • The application meets the minimum threshold for filing before FDA performs its own assessment.

An RTF can be costly in both time and resources. Timelines may slip, development plans may be disrupted, and expectations from investors or strategic partners can be affected. Conducting a thorough readiness review before submission is often the most effective way to avoid these issues.

5. CTD Format and Completeness

Submission success depends on both content and organization.

Most INDs, NDAs, and BLAs are prepared using the Common Technical Document (CTD) structure and submitted electronically through the eCTD framework. This standardized format helps regulators review information consistently across applications.

Each section serves a specific purpose:

  • The Quality (CMC) module demonstrates control of the manufacturing process.
  • The Nonclinical module provides evidence supporting the proposed use.
  • The Clinical module presents study findings in a clear and consistent manner.

Even when the underlying science is strong, poor organization can slow reviews and create unnecessary questions. Presentation matters. A complete submission that is difficult to navigate may still face challenges during the review process.
